1. General Provisions
These provisions govern the terms of use of the khnami-center.com website and other digital services offered by KHNAMI through the website.
“KHNAMI” Palliative Care Center LLC (hereinafter, “KHNAMI”) is an organization providing medical care and services in the Republic of Armenia within the scope prescribed by the legislation of the Republic of Armenia for its activities.
For the purposes of these Terms:
- “Website” means the khnami-center.com website
- “Patient” means a person receiving medical care and services or applying to KHNAMI for the purpose of receiving them,
- “User” means any person using the Website,
- “Customer” or “Payer” means a person who arranges or pays for a service provided to a Patient,
- “Representative” means the Patient’s legal representative or another person whose authority to act on behalf of the Patient is confirmed by the legislation of the Republic of Armenia or an appropriate document.
Using the Website, creating an account, submitting a service inquiry, booking a visit, or using the online payment function means that the User has reviewed these Terms to the extent they are applicable to the relevant relationship.
These Terms do not replace informed consent required by the legislation of the Republic of Armenia, medical documentation, an individual care plan, or, where necessary, a medical services agreement concluded between KHNAMI and the Patient, the Patient’s legal representative, or another duly authorized person.
2. Persons Using the Services
The services offered by KHNAMI through the Website are intended mainly for adults, unless KHNAMI expressly provides otherwise for a specific service.
The Patient may act personally or, in cases provided by the legislation of the Republic of Armenia, through the Patient’s legal representative or another person having such authority.
A relative, family member, or other person may arrange the Patient’s care, contact KHNAMI, or pay for services. However, those circumstances alone do not give that person the right to access information about the Patient’s health condition, medical care, or other information constituting medical secrecy.
Medical information is provided to a relative, payer, or third party only where there is a legal basis provided by the legislation of the Republic of Armenia, also taking into account the consent of the Patient or the Patient’s legal representative.
KHNAMI has the right to require an identity document and a document confirming the basis of representation or authorization before granting access to information about the Patient or opening access to the personal account.
3. Functions Available Through the Website
Depending on service availability, technical capabilities, and the scope of KHNAMI’s activities, the Website may allow users to:
- learn about KHNAMI and its services,
- submit a service inquiry,
- book a visit or consultation,
- apply for the organization of home care or other available services,
- purchase or pay for available services or service packages,
- use the option to arrange an online consultation,
- access a personal account,
- through the personal account, review information about medical services provided, payments, and other related information,
- receive information necessary for organizing services, payment, or other matters.
4. Booking Visits and Confirming Services
Before confirming or starting a service, KHNAMI may:
- contact the Patient or an authorized person,
- clarify the service inquiry,
- verify the person’s identity,
- verify the authority of a representative or another person,
- obtain information necessary for organizing the service,
- arrange a preliminary or professional medical assessment,
- require submission of documents or execution of consents provided by the legislation of the Republic of Armenia or KHNAMI’s procedures.
If a professional assessment determines that the service does not meet the Patient’s medical needs, is unsafe, is unavailable at that time, or cannot be provided within the scope of KHNAMI’s activities, KHNAMI may decline to confirm the service or may offer another appropriate service.
5. Online Consultation and Remote Communication
An online consultation arranged by KHNAMI may, depending on the specific service and the method agreed in advance, be conducted by telephone, video call, or another appropriate means of communication.
Where applicable, the Patient or the Patient’s legal representative may participate in the online consultation.
KHNAMI does not consider an online consultation to be a complete substitute for an in-person medical examination.
6. Patient Personal Account and Account Security
To use the personal account, KHNAMI may require prior registration and identification.
The User must:
- provide accurate and up-to-date information,
- protect their login credentials,
- not transfer access to their account to unauthorized persons,
KHNAMI may temporarily restrict access to an account where this is reasonably necessary for security, data protection, or technical maintenance purposes.
7. Medical Secrecy and Access to Medical Information
Information concerning the Patient’s health condition, medical care and services, examinations, diagnosis, treatment, care, and other information contained in medical records is protected in accordance with the procedure established by the legislation of the Republic of Armenia.
KHNAMI restricts access to information constituting medical secrecy to persons for whom such access is necessary to perform their authorized professional or official duties, as well as other persons or state bodies of the Republic of Armenia entitled to receive such information under the legislation of the Republic of Armenia.
If the Patient or the Patient’s legal representative lawfully authorizes another person to receive certain medical information, KHNAMI may provide that person only with information available within the scope of the authorization.
A payer or a person arranging a service does not acquire the right to receive medical information solely because they paid for the service or are a relative of the Patient.
Without the Patient’s consent, medical information may be provided only in cases where this is permitted or required by the legislation of the Republic of Armenia.
8. Prices and Payments
Unless expressly stated otherwise, prices for services published by KHNAMI are set in Armenian drams (AMD).
Where settlement or payment is made in another currency, currency conversion, the applicable exchange rate, and possible bank or card fees may be determined by the relevant bank, card system, or payment service provider.
Online card payments may be processed through a payment partner used by KHNAMI, including, where arranged accordingly, through the payment infrastructure of INECOBANK CJSC.
If payment card details are entered directly in the secure environment of a bank or payment service provider, KHNAMI does not process or store the full card number or CVV security code, except for data whose processing is necessary to record the fact and status of the transaction and accounting information.
KHNAMI’s separate “Payment, Refund and Cancellation Policy” also applies to payments, refunds, cancellations, and prepayments.
9. Obligations of the Patient, Representative, and Customer
The Patient, the Patient’s legal representative, or an authorized third party must provide KHNAMI with information necessary for the safe and proper organization of the service.
During the service, information must be provided about material changes in the Patient’s condition, known allergies, medications being taken, and other circumstances relevant to organizing care.
The Patient and persons associated with the Patient must treat KHNAMI employees respectfully and must not create situations that endanger the life or health of employees or other persons.
In the case of home care, the Patient or the person arranging the service must, to the extent possible, ensure conditions reasonably necessary for the safe organization of the service.
A person arranging or paying for a service for another person is responsible for the accuracy of the information they provide and for the reliability of the information provided regarding their authority.
10. Cancellation or Termination of a Service by the Patient or Customer
The Patient or an authorized person may terminate future scheduled services in accordance with the procedure provided by the legislation of the Republic of Armenia or the contractual relationship with KHNAMI.
To cancel or reschedule a future home visit or another separately scheduled service, KHNAMI must be notified 24 hours in advance or within another period established by the contract for that service.
The payment terms applicable in the event of cancellation or rescheduling, including any amounts that may be payable in the event of late cancellation, are determined by KHNAMI’s Payment, Refund and Cancellation Policy or by the agreement concluded with the Patient or the Patient’s legal representative.
11. Suspension or Termination of a Service by KHNAMI
KHNAMI may suspend, postpone, restrict, or terminate a service where necessary to:
- comply with the requirements of the legislation of the Republic of Armenia,
- ensure the Patient’s safety,
- ensure the safety of employees or other persons,
- reassess the provision of the service from a medical or professional perspective,
- address conditions that make the safe provision of the service practically impossible,
- respond to the provision of materially false or misleading information,
- address outstanding payment obligations.
If a service is restricted or terminated due to non-payment, KHNAMI will, where possible and unless the circumstances require other action, notify the Patient or authorized person in advance about the situation and its consequences.
12. Information Published on the Website
General information published on the Website is for informational purposes and does not in itself constitute an individual medical diagnosis, treatment plan, or guarantee of a service outcome for any specific person.
Medical care and care services for each Patient are organized based on the Patient’s individual health condition, medical needs, and an appropriate medical assessment.
13. Intellectual Property
Unless expressly stated otherwise, texts, names, logos, structure, and design elements placed on the Website by or for KHNAMI are protected by the legislation of the Republic of Armenia.
The User may use Website content for personal and non-commercial purposes to the extent that such use does not infringe the rights of the rights holder.
Without appropriate permission from the rights holder, it is prohibited to reproduce, sell, publish, distribute, or otherwise use all or a substantial part of the Website content for commercial purposes.
14. Website Availability and Changes
KHNAMI may modify, update, maintain, or temporarily restrict individual Website functions for improvement or security purposes.
These Terms may be amended if KHNAMI’s services, technological solutions, or the legislation of the Republic of Armenia change, in order to bring them into conformity.
Updated information is published on the Website with the relevant effective date.
16. Liability
The User is responsible for the consequences of manifestly incorrect information provided intentionally or negligently by the User, to the extent that such information has a causal connection with the resulting damage or problem.
KHNAMI is not liable for problems arising from the User voluntarily transferring their login credentials to an unauthorized person, except where the damage or violation is caused by KHNAMI’s breach of obligations prescribed by law or contract.

Contacting KHNAMI does not limit a person’s right under the legislation of the Republic of Armenia to apply to a state body, an authority competent to protect rights, or a court.
These Terms are governed by the legislation of the Republic of Armenia.
Disputes are resolved in accordance with the procedure and before the competent authorities or courts prescribed by the legislation of the Republic of Armenia, unless otherwise provided by law or an agreement with KHNAMI.
18. Language and Contact
These Terms may be published in Armenian, English, and Russian.
In the event of inconsistency between different language versions, the Armenian version prevails to the extent that this does not conflict with mandatory requirements of the legislation of the Republic of Armenia.

PAYMENT, REFUND AND CANCELLATION POLICY
1. Scope
This Policy establishes the main terms for payment, prepayment, cancellation, rescheduling, and refunds for paid services offered by KHNAMI through the Website or by another agreed method.
These provisions must be applied together with the terms of the relevant service, the individual agreement, the care plan, and mandatory legislation of the Republic of Armenia.
If the legislation of the Republic of Armenia requires a separate agreement or other medical document for a specific medical service, these provisions do not replace those documents.
2. Prices and Currency
Unless expressly stated otherwise, the official prices of KHNAMI services are set in Armenian drams (AMD).
Prices published on the Website or another official source may be changed for future services.
If the price of a future service changes, that change does not apply retroactively to an agreement that has already been established and concluded.
When payment is made with a card or account in another currency, currency conversion may be carried out by the relevant bank, card system, or payment service provider under the terms established by that organization and at the exchange rate applicable on that day.
3. Card and Online Payments
KHNAMI does not store the full card number or CVV security code if such data are not transmitted to or processed by KHNAMI.
KHNAMI may retain the transaction number, payment status, amount, payment date, service or order information, and other information necessary for accounting purposes.
Payment is considered completed when KHNAMI or its payment system receives successful confirmation of that payment.
An unconfirmed, declined, reversed, or technically incomplete transaction is not considered a completed payment.
4. When Payment Is Due
Unless different terms apply to a specific service, the timing of payment may be established by an individual agreement or agreed in advance by KHNAMI and the Patient.
For certain services or service packages, KHNAMI may require a prepayment or full advance payment.
If, after payment, it becomes clear that KHNAMI cannot provide the relevant service and the parties do not agree on another solution, KHNAMI must refund the amount in full or refund the part corresponding to the portion of the service that KHNAMI was unable to provide.
5. Termination of Future Services
The Patient or another duly authorized person may notify KHNAMI of the termination of services scheduled for the future.
Termination of future services does not affect payment obligations for services already properly provided.
The unused portion of prepaid services is recalculated in accordance with Section 7 of this Policy.
Termination of a service does not mean automatic destruction of medical, accounting, or other mandatory records.
6. Cancellation or Rescheduling of a Scheduled Visit
To cancel or reschedule an individual home visit or another scheduled service, the Patient, the Patient’s representative, or the person arranging the service must notify KHNAMI.
If KHNAMI has established for a specific service that the visit must be cancelled or rescheduled at least 24 hours before the scheduled time, that condition applies to the relevant service in accordance with the procedure published or agreed in advance.
If notice is received less than 24 hours in advance, KHNAMI may apply the late-cancellation condition agreed in advance for the relevant service only to the extent permitted by the legislation of the Republic of Armenia and provided in the terms of that service.
In the event of late cancellation, the amount payable must be clear, available in advance, or agreed between the parties.
If the visit does not take place because of KHNAMI, no late-cancellation fee applies.
In exceptional or force majeure circumstances, KHNAMI may consider each case individually without making such a decision binding for all future cases.
7. Prepaid Services and Service Packages
If the Patient or an authorized person terminates a prepaid service or service package before all services are provided, KHNAMI calculates the value of the services already actually provided.
The general principle for calculating the refundable amount is as follows:
Refundable amount = amount actually paid − value of services already properly provided − actual refund-related expenses incurred and permitted by law.
If a special or discounted price was applied to a service package, the recalculation procedure must be clarified in advance in the package terms.
If the value of services already provided equals or exceeds the amount actually paid, no refund is made, except where otherwise provided by the legislation of the Republic of Armenia or the relevant agreement.
The amount for unpaid services actually provided remains payable in accordance with the applicable terms.
8. Grounds for Refund
A refund may be made, in particular, where:
- the service was paid for but KHNAMI cannot provide it for reasons attributable to KHNAMI,
- a duplicate or incorrect payment was made,
- a refundable amount has been calculated for the unused portion of a prepaid service,
- a refund is provided for in the terms of the specific service,
- a refund is required by the legislation of the Republic of Armenia.
No refund is made for a medical or care service already properly provided solely because the Patient or Customer later changes their decision.
This provision does not limit consumer rights that are mandatorily provided by the legislation of the Republic of Armenia.
9. Refund Timing and Method
After the final amount to be refunded has been determined, KHNAMI initiates the refund within a reasonable period and, unless another period is required by law or contract, usually within 7 business days.
Where possible, the refund is made using the original payment method.
If a refund using the original payment method is technically impossible or another procedure is required, KHNAMI may agree on another lawful and secure refund method.
The payment service provider, bank, or card system may require additional time for the refunded amount to appear in the payer’s account. Such circumstances are outside KHNAMI’s direct control.
Before making a refund, KHNAMI may reasonably take steps to verify the payment, the applicant’s identity, and the applicant’s authority to request the refund.
11. Cancellation or Termination of a Service by KHNAMI
KHNAMI may cancel, postpone, suspend, or terminate a service where this is necessary for medical, professional, safety, or legal reasons.
If KHNAMI terminates a prepaid service for reasons attributable to KHNAMI and no other acceptable solution is offered for the unprovided portion of the service, the unused prepayment balance is recalculated and refunded.
If termination of the service is due to a change in the Patient’s health condition or a professional assessment, KHNAMI evaluates the scope of services already provided and not provided in order to resolve the refund issue.
12. Payment Error or Duplicate Payment
If the payer believes that a payment was made incorrectly, charged twice, or another problem has arisen, the payer must notify KHNAMI.
KHNAMI may require information reasonably necessary to identify the payment and investigate the issue.
If payment fraud is suspected, KHNAMI may carry out necessary checks and provide data to authorized persons or bodies only in cases permitted or required by the legislation of the Republic of Armenia.

14. Applicable Law
These provisions are governed by the legislation of the Republic of Armenia.
If any of these provisions conflict with mandatory rules of the legislation of the Republic of Armenia, the relevant mandatory legal rule applies.
PRIVACY AND PERSONAL DATA PROTECTION POLICY
1. General Provisions and Data Controller
Within the scope of its activities, KHNAMI processes personal data in accordance with the legislation of the Republic of Armenia.
KHNAMI is responsible for its processing of personal data where it determines the purposes and means of such processing.
These provisions apply to personal data processing carried out by KHNAMI in connection with the Website, Patient personal data, bookings, organization of medical care and services, communications, payments, and related activities.

Data concerning health condition and medical care may be considered personal data subject to special protection and, at the same time, may constitute medical secrecy in cases provided by the legislation of the Republic of Armenia.
2. Scope of the Provisions
These provisions may apply to:
- persons receiving or applying to receive KHNAMI services,
- legal representatives of the Patient,
- persons authorized by the Patient,
- persons arranging or paying for the Patient’s care,
- registered users of the Website or personal account,
- persons contacting KHNAMI electronically, by telephone, or by another method,
- persons using the Website.
3. What Data We May Process
Depending on the person’s status and the service being received or arranged, KHNAMI may process the following data:
3.1. Identification and Contact Data
- first and last name,
- date of birth,
- sex,
- address,
- telephone number,
- email address,
- necessary information from an identity document,
- information necessary to confirm the identity and authority of a representative or authorized person.
3.2. Health and Medical Data
Depending on the service:
- medical history,
- diagnoses,
- complaints and symptoms,
- information about medications being taken,
- information about allergies,
- examination and laboratory results,
- medical and care records,
- treatment or care plans,
- medical documents provided to KHNAMI,
- other health information necessary for organizing the Patient’s care.
3.3. Photographs
For medical or care purposes, where necessary, photographs required to document the Patient’s health condition, the course of care, or changes in it may be processed.
3.4. Payment and Service Data
- selected services,
- bookings,
- payment status,
- amounts paid,
- invoices and calculations,
- information about refunds.
If card data are entered directly in the fields of a bank or payment service provider, KHNAMI does not store the full card number or CVV code.
3.6. Communication Data
- emails,
- messages,
- inquiries,
- complaints,
- data concerning the organization of visits and consultations,
- records of consents or authorizations given,
- other communications necessary for organizing services or complying with legal requirements.
4. Sources of Data
KHNAMI may receive personal data from:
- the Patient,
- the Patient’s legal representative,
- an authorized person having the relevant authority,
- KHNAMI healthcare professionals and employees during the provision of services,
- other persons lawfully involved in the Patient’s care or treatment,
- payment or technical service providers,
- healthcare or other state bodies of the Republic of Armenia where receipt of the data is permitted or required by law.
A person providing data about another person is responsible for transmitting those data.
5. Purposes of Personal Data Processing
KHNAMI processes personal data for the provision of services and other lawful purposes, including to:
- assess, organize, provide, and document medical care and services,
- plan and provide palliative and other care,
- identify the Patient,
- verify the authority of a representative or authorized person,
- organize visits and consultations,
- maintain medical documents and care-related records,
- operate the Patient’s personal account,
- provide relevant information to the Patient or an authorized person,
- manage payments, invoices, prepayments, and refunds,
- fulfil accounting obligations required by law,
- record or update data required by law in electronic healthcare systems,
- ensure the security of the Website and information systems,
- prevent fraud and unauthorized access,
- respond to inquiries and complaints,
- comply with legal requirements or protect rights,
6. Health Data and Medical Secrecy
The protection of health data is of particular importance to KHNAMI.
Access to the Patient’s medical data is granted only to employees and other persons for whom such access is necessary to perform their professional or work duties or who are entitled to receive such information under the legislation of the Republic of Armenia.
7. Access by Representatives and Relatives
KHNAMI may verify the identity and authority of a person who applies on behalf of the Patient or wishes to receive protected information about the Patient.
Where a valid permission or authorization exists, KHNAMI may determine the scope of access taking into account the authority granted and the nature of the information.
11. Data Recipients and Service Providers
Where necessary and on a lawful basis, data processed by KHNAMI may be made available or transferred to:
- authorized KHNAMI healthcare professionals,
- care specialists,
- relevant administrative employees,
- IT and information security specialists,
- operators of healthcare systems provided by law,
- competent state authorities,
- payment service providers,
- courts, law-enforcement, or regulatory authorities in cases provided by law.
KHNAMI provides data only to the extent necessary for the purpose of the relevant transfer or service.
13. Payment Data
Online payments are processed through banking or payment infrastructure used by KHNAMI.
KHNAMI may retain the transaction amount, payment status, payment date, and other data necessary for accounting or dispute resolution.
15. Photographs
Photographs may be taken or stored where necessary to document medical care, care, or changes in health condition.
Photographs of an identifiable Patient are not published for advertising, public, or marketing purposes without an appropriate separate legal basis and, where necessary, the proper consent of the Patient or the Patient’s authorized representative.
When clinical images are used for professional training, scientific, or presentation purposes, KHNAMI applies the personal data and medical secrecy protection measures required by the legislation of the Republic of Armenia.
The mere fact that a face is not visible is not always sufficient in itself to exclude the possibility of identifying a person.
16. Data Retention Periods
KHNAMI retains personal data only for as long as necessary for the purpose of processing, unless the legislation of the Republic of Armenia establishes a longer mandatory retention period for the relevant type of information.
Medical records are retained for the periods established for the relevant type of document by the healthcare and archival legislation of the Republic of Armenia.
Payment and accounting data are retained for the periods prescribed by the tax, accounting, and other applicable legislation of the Republic of Armenia.
Security, system, and technical records are retained only for as long as necessary for security, prevention of violations, operation of the system, or compliance with legal requirements.
If retention periods change by law, the mandatory requirements in force at the relevant time apply.
